Our community was founded in 2007, a development that was taken over by Kolter Homes. The community has been under developer run POA for 17 plus years. This is well outside the standard and a huge outlier in Florida. We have to ask why? There is an associated CDD (CDD#5) also run by Kolter Homes. To date we have no resident board member for Village Emilia (VE) nor Verano Property Owners Association (VPOA).
Do you know we don't own our amenities? At POA to HOA turnover, Kolter will sell the amenities, offering purchase to residents first, for approximately $55M - or $22k per home (based on buildout of 2775). Note: if residents choose "not to buy" they can sell to third party and open to the public as they so choose.
This was not disclosed to homeowners at closing. In fact, the Developer can change the dollar value at will, along with any other "Rules" without resident disclosure. They only have to file the changes with the County Clerk and we have to abide by what they state. Our amenities are currently owned by an entity of Kolter Homes, who take profit right off the top calling them Membership or Owner Fees. A recent court case decision by Florida Supreme court ruled against this developer model, please refer to Avatar V Gundel for complete details. Despite the ruling, Kolter continues to profit off the homeowners.
UPDATE: The CROV Association consists of more than 630 home owners and we are reviewing options with similarities to Avatar v Gundel and researching the overall governance of our community CDD. Working with Jamie Fowler County Commissioner and Dana Trabulsy, State Representative, who are reviewing overall CDD Operations.
CROV has approached our Board President, Josh Hoot on working within the budget to reallocate funds from other areas to fund 24 / 7 Security. Josh responded favorably and would like to work together by receiving our suggestions. Please send your suggestions to info@crovassociaiton.org. We love our community and are working hard to take action against the current CLUB PLAN, our Developer and Property Management Company.
