Our community was founded in 2007, a development that was taken over by Kolter Homes. The community has been under developer run POA for 17 plus years. This is well outside the standard and a huge outlier in Florida. We have to ask why? There is an associated CDD (CDD#5) also run by Kolter Homes. To date we have no resident board member for Village Emilia (VE) nor Verano Property Owners Association (VPOA).
Do you know we don't own our amenities? At POA to HOA turnover, Kolter will sell the amenities, offering purchase to residents first, for approximately $55M - or $22k per home (based on buildout of 2775). Note: if residents choose "not to buy" they can sell to third party and open to the public as they so choose.
This was not disclosed to homeowners at closing. In fact, the Developer can change the dollar value at will, along with any other "Rules" without resident disclosure. They only have to file the changes with the County Clerk and we have to abide by what they state. Our amenities are currently owned by an entity of Kolter Homes, who take profit right off the top calling them Membership or Owner Fees. A recent court case decision by Florida Supreme court ruled against this developer model, please refer to Avatar V Gundel for complete details. Despite the ruling, Kolter continues to profit off the homeowners.
Hi all, happy to provide an update on the progress made with our developer and management team. As you know we will be meeting on March 25, 2025 for a Resident Townhall Meeting. While they denied our group the ability to hold a meeting, they have dedicated their townhall to Transition from Developer POA to Resident HOA. As CROV Board President, I remain cautiously optimistic at the improvement in the relationship with Kolter & Lang. a There is a lot to consider in a transition, let alone of a community this size, but we have many talented residents who will undoubtedly bring their skills to the table.
